1. About Éritaj FM and Scope
Radio 1804, Éritaj FM ("Éritaj FM," "we," "our," or "us") is a cultural and internet-radio initiative operated as a division of The InterfineArt Group, LLC. Éritaj FM exists to preserve, promote, celebrate, and transmit Haitian and Caribbean music, history, language, arts, stories, and cultural memory, including the African cultures that continue to shape the region.
These Terms apply to eritajfm.com (the "Site") and to services that link to or expressly incorporate these Terms, including station pages, streams, program information, forms, submissions, interviews, listener participation, events, promotions, sponsorship opportunities, and community features (collectively, the "Services"). If a feature described here is not offered, the provision relating only to that feature does not apply until that feature is made available.
2. Eligibility and Acceptable Use
You may use the Site and Services only in compliance with applicable law and these Terms. If you use the Services on behalf of an organization, business, artist, label, sponsor, or other entity, you represent that you are authorized to act for that entity.
You may not attempt to interfere with Site security, bypass technical restrictions, introduce malicious code, scrape or harvest data in a manner that disrupts the Services, impersonate another person, misuse forms or communications, or use the Services for fraudulent or unlawful purposes.
Where a transaction or agreement requires legal capacity, you must be at least 18 years old or otherwise legally capable of entering into that transaction under applicable law.
3. Intellectual Property
Unless otherwise identified, the Site design, original text, station imaging, original photographs and graphics, logos, branding, program names, compilations, and other original Éritaj FM materials are owned by or licensed to The InterfineArt Group, LLC and are protected by applicable intellectual-property laws.
Music, sound recordings, compositions, performances, artist names, trademarks, album artwork, photographs, videos, interviews, and other third-party works remain the property of their respective owners. Éritaj FM does not claim ownership merely because a work is broadcast, embedded, discussed, reviewed, displayed, or promoted.
No access to the Site or Services grants you ownership of, or a license to reproduce, redistribute, publicly perform, publicly display, sell, modify, create derivative works from, or commercially exploit any protected content except as expressly authorized by the applicable rights holder or by law.
4. Streaming and Broadcast Use
Éritaj FM programming and streams are intended for personal, non-commercial listening unless we expressly authorize another use. You may not record, capture, rebroadcast, retransmit, redistribute, sell, sublicense, or make the station stream or programming available through another service, website, application, venue, or network without the necessary authorization.
Where Éritaj FM uses Live365 or another licensed streaming provider, music licensing and royalty reporting are governed by the applicable provider agreements, territorial coverage, rights-organization agreements, and applicable law. Any such licensing applies only within the scope of the provider's licensed service. It does not automatically grant rights for downloads, on-demand distribution, archived copies, social-media videos, independent website jukeboxes, or reuse on another network.
Éritaj FM may apply geographic, technical, metadata, scheduling, or programming restrictions to satisfy licensing requirements and applicable law. Program schedules may identify shows and dayparts without guaranteeing exact song titles, artists, albums, or transmission times.
5. Copyright Complaints and DMCA
Éritaj FM respects the rights of artists, musicians, composers, producers, publishers, labels, photographers, filmmakers, writers, and other copyright owners. If you believe material available through the Site infringes your copyright, send a written notice to jacompas@eritajfm.com.
A copyright notice should identify the copyrighted work, identify the material claimed to be infringing and where it appears, provide your contact information, state your good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law, state that the information is accurate and that you are authorized to act for the rights holder, and include your physical or electronic signature.
We may remove or disable access to material while a claim is reviewed and may request additional information. We may also terminate or restrict participation by users who repeatedly infringe intellectual-property rights.
6. User and Artist Submissions
You may have opportunities to send messages, photographs, event notices, testimonials, reviews, video links, audio, artwork, music, promotional materials, or other content ("Submissions"). You represent that you own your Submission or have all rights, releases, licenses, consents, and permissions needed to submit it and permit the uses you authorize.
For general community Submissions, you grant Éritaj FM a non-exclusive, worldwide, royalty-free license to host, reproduce, display, publish, excerpt, format, archive, and promote the Submission as reasonably necessary to operate, publicize, document, and improve the Services. This license does not transfer ownership of your Submission to Éritaj FM.
Music and artist submissions may be subject to separate submission terms, permissions, licensing confirmations, or partner agreements. Submission of a recording does not guarantee broadcast, playlist placement, chart position, Artist of the Month selection, editorial coverage, or any other promotional outcome. Paid partnership, advertising, or sponsorship does not purchase editorial ranking or airplay.
We may decline, edit for length or format, remove, archive, or restrict a Submission where reasonably necessary for editorial, technical, legal, safety, or community reasons.
7. Calls, Interviews and Listener Interactions
Éritaj FM may offer live or recorded interviews, call-in programs, chats, comments, social-media interactions, voice messages, contests, community discussions, or similar participation.
By knowingly participating in a live or recorded program, you acknowledge that your voice, name, likeness, statements, and contribution may be transmitted live and may be recorded, edited for technical or editorial purposes, archived, rebroadcast, quoted, excerpted, or promoted in connection with Éritaj FM, subject to applicable law and any separate release or agreement.
Opinions expressed by callers, guests, interviewees, creators, advertisers, or community participants are their own and do not necessarily represent the views of Éritaj FM or The InterfineArt Group, LLC.
8. Community Standards
Éritaj FM is intended to support cultural exchange, discovery, education, and respectful community participation. Users may not submit or transmit content that is unlawful, fraudulent, threatening, harassing, defamatory, deliberately deceptive, invasive of privacy, infringing, malicious, spam, or designed to compromise the security or operation of the Site.
We may moderate, refuse, remove, disconnect, restrict, or block participation when reasonably necessary to protect the station, its audience, participants, partners, legal rights, or technical systems.
9. Advertising, Sponsorship, Promotions and Partnerships
Éritaj FM may offer paid advertising, sponsorships, underwriting, branded content, affiliate relationships, event promotion, and community partnerships. Unless expressly stated otherwise, the appearance of an advertiser, sponsor, product, service, or external organization does not constitute an endorsement by Éritaj FM.
Advertisers and sponsors are responsible for the accuracy, legality, substantiation, clearances, intellectual-property rights, and regulatory compliance of materials they provide. Éritaj FM may reject, suspend, modify, reschedule, or terminate an advertising or sponsorship arrangement in accordance with the applicable agreement, these Terms, station standards, or law.
Specific advertising, sponsorship, promotion, contest, event, or partner arrangements may be governed by separate written terms. If those terms conflict with these general Terms, the specific written agreement controls for that transaction.
10. Payments, Donations and Use of Revenue
Commercial payments to Éritaj FM, including advertising, sponsorship, underwriting, promotional, membership, or partnership fees, support station operations and may be used for broadcasting, streaming, licensing, website services, equipment, studio operations, promotion, programming, administration, community outreach, cultural projects, and future development.
Unless expressly identified as a charitable contribution to a qualified nonprofit organization, payments to Éritaj FM or The InterfineArt Group, LLC are commercial payments and should not be treated as tax-deductible charitable donations.
Where the Site provides a donation link for Fondation Jacques Stephen Alexis, USA, any charitable contribution is made to that organization through its designated donation process and is subject to the foundation's own policies, eligibility, receipting, and applicable nonprofit law. Éritaj FM does not promise tax deductibility for any payment unless the recipient organization lawfully provides that treatment.
11. Privacy, Cookies and Analytics
Depending on the features you use, the Site may receive information such as your name, email address, contact details, messages, IP address, browser and device information, approximate location derived from network information, referral information, website activity, and streaming or engagement data.
Information may be used to operate and secure the Site, respond to inquiries, process applications, deliver requested communications, understand audience use, improve performance, administer promotions or partnerships, comply with law, and protect rights and safety.
The Site may use cookies, logs, analytics, embedded media, or similar technologies supplied by Éritaj FM or third-party service providers. Browser settings may allow you to restrict cookies, although doing so can affect functionality.
Éritaj FM does not sell personal information for money. Information may be disclosed to service providers that support the Site or Services, to transaction or streaming partners where necessary to provide requested functionality, in connection with a lawful business transaction, or where disclosure is required or permitted by law.
12. Third-Party Services and Links
The Site may link to or embed services operated by third parties, including Live365, YouTube, Bandcamp, Amazon, social-media platforms, payment providers, sponsors, artists, cultural organizations, or other external websites. Third-party services are governed by their own terms, privacy policies, availability, and technical practices.
Éritaj FM does not control and is not responsible for third-party content, security, availability, products, transactions, statements, or privacy practices. A link or embed does not by itself imply endorsement.
13. Service Changes and Availability
Éritaj FM may add, modify, suspend, reschedule, replace, or discontinue programming, Site features, streams, promotional opportunities, partnerships, or other Services at any time. We do not guarantee continuous availability, uninterrupted streaming, preservation of any particular feature, or compatibility with every device, browser, platform, or territory.
14. Disclaimers
To the fullest extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis. Éritaj FM disclaims warranties that the Site or Services will be uninterrupted, error-free, secure, complete, or suitable for every purpose.
News, commentary, interviews, cultural material, historical discussion, entertainment, recommendations, advertisements, and third-party information may contain opinions or information supplied by others. Éritaj FM does not warrant the accuracy or completeness of third-party statements and is not responsible for decisions made solely in reliance on them.
Nothing on the Site constitutes legal, medical, tax, investment, or other professional advice.
15. Limitation of Liability
To the maximum extent permitted by applicable law, The InterfineArt Group, LLC, Éritaj FM, and their respective owners, officers, directors, employees, contractors, volunteers, contributors, affiliates, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss arising from inability to access or use the Site or Services.
Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these limitations apply only to the extent permitted by law.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The InterfineArt Group, LLC and Éritaj FM from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or a Submission that infringes or violates another person's rights. This provision does not require indemnification for conduct that cannot lawfully be shifted to you.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles. Except where applicable law requires otherwise, disputes arising from these Terms or the Site will be brought in a state or federal court having jurisdiction in Broward County, Florida, and the parties consent to jurisdiction and venue there.
18. Changes to These Terms
We may update these Terms to reflect changes in law, technology, Site functionality, station operations, partnerships, or business practices. The revised version will be posted on this page with an updated effective or "last updated" date. Your continued use after an update becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
19. General Terms
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. Failure to enforce a provision is not a waiver. Headings are for convenience only. These Terms, together with any additional terms expressly applicable to a particular feature, transaction, promotion, submission, sponsorship, or service, form the applicable agreement concerning your use of that feature or service.
No provision of these Terms transfers ownership of intellectual property or creates an employment, agency, joint-venture, fiduciary, or partnership relationship between a user and Éritaj FM merely because the user accesses or participates in the Services.
